What do they do to you if you committed a crime in self defense and you report it yourself?

02 Apr

Do you go to jail until your trial? Do they just not prosecute you at all? What happens?

(I’m writing a story where a girl murders her abusive stepdad)

why do i need an attorney for possession of marijuana?

02 Apr

In May I got arrested for minor in consumption of alcohol, minor in possession of tobacco and possession of marijuana. I’m 17. If I would have been 18 I wouldn’t have gotten arrested, just a ticket. I have never been in trouble before (besides one minor in poss. of tobacco last august) I finally got my court date and they said I need an attorney. Why?!? What could they make me do? (fines…probation…comm. service…etc) I live in Kansas.
haha well:
1. im def. not a thug. if you saw me you wouldnt even know i used to smoke
2. i had a little less then a quarter

Can a misdemeanor that had been agreed upon between attorney and DA, be brought back to a felony?

02 Apr

My fiance was charged with 2nd degree burlary and his attorney and DA agreed upon dropping it to a misdemeanor with one year probation. He has not signed the paperwork yet. The disposition was filed. He recently was charged with another misdemeanor and i’m wanting to know if the DA can go back and re-charge him with a felony on the burlary.

law/drug possession question?

01 Apr

For my law class I am doing a mock trial, and I am the lead defense attorney.

The defendant is accused of drug possession and selling of marijuana.
One of the prosecutions pieces of evidence is that through police surveillance, they have noticed “a steady stream of students entering and leaving the house while his parents are at work.” This is supposed to support the idea that he is a drug dealer.

Does anyone have a good, plausible explanation as to why this would be, other than that he is selling illegal drugs?

thanks!

:]
*also, the cops have noticed him wearing expensive clothes, and adding “expensive, high preformance components” to his car. They also found weed in his house, during a house party he was throwing, but that is, at least to me, circumstancial evidence, as it cannot DIRECTLY link him to the weed.

and thanks for all the help, everyone(:
Apparently the expensive clothes is supposed to mean he is making alot of money all the sudden. I feel that this is really jumping to conclusions.
Sorry for adding so many detail, everyone. But everyone who answers says they need more facts..

so hereswhat I know..

all the police found in their search of his house:
- seven kilogramsof marijuana. (in his house, not in HIS room, car, or on his person)
- more than 2,500 in cash
- a folder marked “business” with the name and number of the already convited drug dealer who gave the police the kids name as part of his plea bargain.

he was charged under title 21, united states code, section 84(a)(1), S 841 prohibited acts.

Do State Crime Labs communicate with prosecution and defense teams?

01 Apr

As I understand it, State Crime Labs in the US receive evidence samples from police and return reports on those samples to police. Do they also communicate with members of the prosecution teams when those cases come to trial? Do they communicate with the defense teams of those accused?

My husband is Trini and was charged with possession of a drug, does he stand a chance of immigrating to the US?

01 Apr

I’m filing an I-130 but am terrified that the consulate in Trinidad might deny him approval. The possession charge was for 0.002grams of a hard drug. He doesn’t do or sell drugs. He was hanging around the wrong people at the wrong time and got set-up by the corrupt police. He stupidly listened to his hustling lawyer and plead guilty to the charge to avoid jail time or a trial. Does anyone have or has had a similar situation occur? Please share.

How do I find accurate information and statistics on drug-related crimes?

01 Apr

I am writing a paper on the Effects of Needle Exchange Programs. I have come across TONS of info about the programs’ effects on HIV transmission and drug-use, but I’d like to confront the claim that NEPs contribute to an increase in crime.
I know that often times, drug-related crimes in a city with a NEP may become centralized to the area around the program (because that’s where the drug users end up being more often), and that syringe possession w/o a prescription is illegal (possibly altering the actual results by Possession of Paraphernalia crimes).
How can I accurately provide data, especially on more than one city, while taking into account these variables? Where can I find this kind of information?

PLEASE HELP!!! I only have three weeks to come up with this information!

P.S. I’ve accessed a lot of the criminal websites, but don’t know how to factor in the variables, or where I can find information that has them already factored. I need a study to look at on the topc
I’ve accessed alot of the criminal statistic sites you all are mentioning, but the problem is factoring in the variables of centralization and syringe possession. I could really use information on any studies completed on the subject of Needle Exchanges and Crime, but don’t know how to find out if any have been done. If they have, how do I find the results?
Is there a way I can quickly and fairly easily factor in these results myself and at least be able to give an educated guesstimate on how much of an impact NEPs have on crime?

Can a good attorney get a first time offender, no criminal record, out of felony drug posession charges.?

01 Apr

Drugs were found in a vehicle after a random traffic stop, they found drugs in the vehicle, but not on the driver, who was driving a friends car. It’s basically choosing a good attorney with experience vs public defender just out of law school.

Can I go to the trial myself instead of hiring an attorney when I try to get possession of an occupied house?

01 Apr

Our properties are occupied by tenants who don’t want to move out. We hired attorneys to help us when we go to trial at court. That’s just a normal procedure. Attorney asked me the same questions every time. I am wondering, maybe I can just go to the trial myself and save some attorney fee. I am in L.A, california, by the way.
